General terms and conditions

We can’t do it without any rules. Therefore, read our terms and conditions carefully. You agree to them with the registration.

1 workshop contract

1.1 The registration for our courses takes place via our shop.  With the registration confirmation, which you will receive immediately by mail, it becomes binding. The contract is therefore concluded with this registration confirmation and does not require a specific form. The basis of the offer are the explanations, which you can read again on this website under the course descriptions.

1.2 Please note that the number of participants for our courses is limited, the maximum number of participants can be found in the respective course description. You can get an overview of the available places by selecting the corresponding course on the store page.

2 Payment

2.1 You pay for the workshop when you register in the store and receive an invoice as soon as we receive the money. For the Hellazz workshops there is the possibility of a deposit, you can find the details in the store on the page of the corresponding course. The full workshop fee must be paid at least 30 days before the Hellazz workshop.

2.2 As soon as we have received the deposit, your workshop place is guaranteed, unless the number of participants according to 1.2 has already been exceeded.

3 Leistungen und mögliche Änderungen

3.1 Die näheren Leistungsmerkmale zum Kurs sind auf der oben genannten Webseite beschrieben.

3.2 Es ist dem Veranstalter grundsätzlich gestattet, nötigenfalls auf andere Räumlichkeiten am Veranstaltungsort auszuweichen und die Dozenten zu ändern. Falls der Workshop nicht die ausreichende Zahl von Buchungen erreicht, darf der Veranstalter den Kurs auch von nur einem Dozenten unterrichten lassen und/oder mehrere Kurse nach Maßgabe von Nr. 5 dieser Bedingungen zusammenlegen.

4 Cancellation by the customer

4.1 The workshop can be cancelled by you in accordance with the following provisions; you must inform the organizer of the cancellation in writing or in text form – however, an individual agreement, e.g. by telephone, is also possible.

4.2 In the event of a cancellation of the registration, the organizer may claim reasonable compensation from you. In any case, we charge for the cancellation a lump sum of 25.00 euros plus VAT at the applicable rate (currently 19%), so a total of 29.75 euros.

4.3 If we have to cancel another participant as a result of a registration and after a cancellation on your part, and if we therefore cannot find a substitute participant to replace your place, we will unfortunately have to charge you the full course fees, unless we save expenses as a result of your cancellation, which we will then of course deduct from the course fees.

4.4 With regard to all of the above points, you are of course always allowed to prove that we had no or only lower costs due to your cancellation. In this case, our claim is of course correspondingly lower.

5 Cancellation by the organizer

5.1 If less than 30 participants in total have registered for the Hellazz workshop up to 60 days before the start of the event, the organizer can cancel the workshop completely. The workshops in Berlin can be cancelled completely if the minimum number of participants advertised in the course has not been reached one week before the workshop starts.

5.2 If the number of eight participants in a workshop week is not reached 30 days before the start of the event (concerning Hellazz workshops), the organizer may cancel the course or combine two courses.

5.3 The fees paid will of course be refunded in the event of cancellation on our part. Costs already incurred for travel or cancellation insurance can only be refunded in the event of our liability under Section 7 of these terms and conditions.

6 Services not used

If a participant does not make use of individual services (e.g. seminar hours or meals) or returns home early, there is no entitlement to a pro rata refund of the course price, unless we are liable for this under No. 7 of these conditions.

7 Exclusion of claims/liability

7.1 Claims for damages by the participant are excluded unless otherwise stipulated below. The above exclusion of liability also applies in favor of the legal representatives and vicarious agents of the organizer, insofar as the participant asserts claims against them.

7.2 Excluded from the exclusion of liability set forth in Section 7.1 are claims for damages based on injury to life, limb or health and claims for damages based on the breach of material contractual obligations. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract. Also excluded from the exclusion of liability is liability for damages resulting from an intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents.

8 Agreement with the participants

8.1 The instructors engaged by the organizer are characterized by high professional competence with years of experience – both musically and pedagogically. Each participant should be clear about the nature of the teaching (group work with intensive personal attention). In order to ensure the exceptional quality of this work, the organizer reserves the right to intervene if the teaching process is significantly threatened or disturbed by improper or boycotting behavior of a participant. The participant can be excluded from the lessons in case of such significant reasons. In this case, the participant has no right to reimbursement.

8.2 You agree that your contact details will be included in a list of participants and will also be made available to the other workshop participants in the members’ area of the website. Only the participants of the respective course and the instructors have access to the members area. This could be useful for carpooling or other exchanges. If you don’t want this, please let us know when you register.

8.3 Photos and videos taken during the workshop may be published for self-promotion and documentation. If you do not want this, please announce it explicitly at the beginning of the workshop.

8.4
Recording of the seminar lessons is only permitted with the consent of the lecturers and may only be used for private purposes.

9 Final provisions

9.1 German law shall apply to the exclusion of international conflict of laws provisions. 

9.2 If, however, any other national law of an EU country to which the Participant is subject and which is more favorable to the Participant conflicts with this, this law shall naturally take precedence over the provision under 9.1. 

9.3 In the event of invalidity of individual or all of the aforementioned conditions, the statutory provisions shall apply.

Notes on the right of revocation

The German right of withdrawal does not apply to services that are excluded from the provisions of distance contracts in Section 312 g (2) sentence 1 no. 9 of the German Civil Code (BGB), such as leisure services provided at a specific time or within a precisely specified period.
